LIMITED LIFETIME WARRANTY AND PURCHASE CONDITIONS
The Balcony Company Inc. ("TBC") guarantees its products on the following terms and conditions and with the following limitations:
Definition of Lifetime:
The Limited Lifetime Warranty is good for as long as DecIron is in business.
Definition of Product:
The Limited Lifetime Warranty applies to any iron product that is sold by TBC with the exception of products sold “as is”, on clearance, or at a discounted price because of a product defect or given as compensation.
FILING CLAIMS
All claims should be made in via email, enclosing pictures of the product, sufficient for TBC to determine whether this Limited Lifetime Warranty applies, and how.
TRANSPORTATION
TBC’s products are insured in transit and therefore are guaranteed to arrive undamaged. The purchaser must inspect the product immediately upon receipt and notify TBC immediately if there has been damage in transit. The purchaser has the option to get the product
repaired locally and bill FEDEX by filing a claim themselves or use our help to deal with the claim. Repair bills are normally honored by FedEX within 2 months time, and at that time the purchaser will receive the money.
In case of total loss, TBC will immediately replace the product with a stock item or start the fabrication of a new product to replace the one damaged during transportation. TBC will file a claim with FedEX to recover the money, plus any other legitimate expenses that the purchaser wants us to
include in our claim. However, the purchaser understands, that such claims will be honored at FEDEX's discretion.
The customer understands that for us to file a successful claim, FEDEX officials may decide to send an inspector to visually inspect the damaged balcony and pick up the balcony to salvage it in case of a total loss.
Failure to keep the balcony until the entire claiming process finishes or to return the product to us will result in liability for the whole value of the damaged product.
Typical claims that are not honored are: labor losses, missed dead lines fees or fines, emotional distress, etc.
TBC offers the regular shipping service through our website, which does not include lift-gate service, or moving the package inside the house. Therefore it is the customer's responsibility to have means to unload the crate. This may include a forklift or enough people to dismantel the crate and pull out
the pieces one by one. Should you need lift gate services, please call us or select it at time of purchase.
Reconsignment fees apply if you need to change the address you originally provided at the time of purchase, this fees are not covered and must be paid by the customer.
REGISTRATION
Defective installation voids the warranty, therefore it is necessary that you register the warranty with us at the time of installation. We require that you send us pictures of the installed balcony and close up pictures showing that the balcony has been sealed properly according to our installation guidelines.
We will send you proof of registration. And your pictures will be accessible on our website.
SEAL YOUR BALCONY
Be aware that the water could intrude the balcony platform and make the balcony rust from the inside. Therefore sealing the balcony is a requirement to honor the warranty.
EARLY DETERIORATION
The purchaser is responsible to take reasonable care with the product. The product MUST be cleaned periodically to avoid clay stains, which resemble oxidation. During the first three months after installation, the purchaser must watch for scratches or paint defects and remediate them immediately.
Platform surfaces will show scratches and normal wear and tear and those are not covered by this Limited Lifetime Warranty. The surface is not intended for shoe traffic. Floors should be covered with epoxy paint, vinyl or other appropriate floor covering, if they are going to be walked on with shoes.
If the product shows rust spots within WARRANTY LIMITS of the invoice date or the time of registration, TBC will arrange to remediate the problem at no cost to the purchaser. Once the warranty limits have been reached TBC will charge 75% of its regular rate plus materials to remediate rust.
Once the product has been re-painted by DecIron the Limited Lifetime Warranty renews automatically for another year. Repairs made by a third party void this Limited Lifetime Warranty.
PAINT AND POWDER COATS WARRANTY
After years of successful experience The Balcony company is willing to extend the warranty of the finish from 1 to 3 years, this is effective for products purchased starting January 1 2020, and applies to customers that chose the "double powder coating option at the time of purchasing the balcony or any other product.
For those who have chosen the standard prime and enamel paint finish, we still offer a one year warranty under this document's conditions.
EXTENDED WARRANTIES
The balcony company may offer extended warranty programs beyond the standard warranty. This warranty must be acquired at the time of purchase and registered at the time of installation.
WELDS WARRANTY
Welds are guaranteed not to break from regular use. This is the warranty part that has no limit, during the life of this business.
INSTALLATION AND SAFETY WARRANTY
TBC guarantees that its products exceed International Building Code requirements. This includes the railing's height and its minimum strength, the clearance between pickets, and 100 lb/sft live load capacity.
However, load capacity depends on proper installation. We provide basic framing guidelines, however, a local engineer needs to approve the wall where the product is going to be installed.
TBC does not guarantee, and its insurance does not cover, the quality of the wall or any structure to which its product is attached. It is the responsibility of the installation contractor, or the customer, to ensure a quality framing or concrete wall.
If there is water damage, termites, or any other deterioration in the walls holding the balcony or railings, DecIron is not responsible.
SATISFACTION WARRANTY
TBC guarantees that the product shown online is similar to the one the purchaser will get. With time, products are improved and slight differences might be noticed. We guarantee that the specs presented to the customer are the same or less than the actual
product that the customer will receive.
RETURNS
Product sent by TBC incorrectly may be returned and will be replaced at TBC's expense. Defective or damaged products will be repaired or replaced at the discretion of TBC. If the product is defective beyond repair, it will be replaced.
CUSTOM MADE PRODUCTS
Custom made products cannot be returned.
REPAIRS BY OTHERS
If repairs need to be made to a defective product, TBC requires digital images of the needed repairs. One of TBC estimators will assess the damages, and calculate a fair amount to be reimbursed to the customer for the repairs. This amount will be based on local labor rates for the involved trade, welding or painting.
TBC will choose the contractor to perform the repair; but the customer is responsible to pay their bill at the time the services have been completed at the purchaser's satisfaction. Thereafter, the bill must be submitted to TBC for payment.
THE LIMITED LIFETIME WARRANTY SET FORTH ABOVE IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR USE AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON OUR PART, AND TBC, NEITHER ASSUMES, NOR AUTHORIZES ANY OTHER PERSON TO ASSUME, ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF ITS PRODUCTS. THIS WARRANTY SHALL NOT APPLY TO ANY PRODUCT WHICH HAS BEEN SUBJECT TO ACCIDENT, NEGLIGENCE, ALTERATION, ABUSE, OR MISUSE. THIS WARRANTY SHALL APPLY ONLY WITHIN THE BOUNDARIES OF THE CONTINENTAL UNITED STATES.
